Terms and Conditions for RT FlexPool
These terms and conditions outline the general agreement for Services provided by New Jersey Respiratory, Inc. (NJRA). Specific terms applicable to individual agreements or circumstances may vary and are subject to separate written agreements.
1. Services Provided
NJRA offers respiratory care services ("Services") through the RT FlexPool to various healthcare entities. These Services are provided by licensed respiratory therapists as prescribed by an attending physician and include, but are not limited to, RT assessments, airway management, therapies, treatment plans, and education for patients, staff, and family.
2. Staffing and Supervision
NJRA employs independent contractors who are credentialed and licensed to provide respiratory care services in the state of service. NJRA ensures supervision by experienced personnel to maintain the quality and compliance of the Services.
3. Compliance with Laws
NJRA and all personnel must comply with all applicable laws, including but not limited to health care regulations, HIPAA, and other privacy laws regarding Protected Health Information (PHI). NJRA cooperates with regulatory inspections and investigations related to the Services provided.
4. Fees and Payment
Fees for Services provided by NJRA are subject to change based on demand and specific service requirements. All payments are due within 30 days of invoicing. Specific fees and payment terms can be found on our website or provided upon request.
5. Term and Termination
These terms are effective upon the start of Services and continue until terminated by either party with 30 days notice. NJRA may terminate Services immediately under certain conditions such as non-payment or breach of legal requirements by the customer.
6. Insurance
NJRA maintains comprehensive liability and professional liability insurance to cover potential claims arising from the Services provided. Details of the insurance coverage are available upon request.
7. Indemnification
Both parties agree to indemnify each other against any losses, damages, or expenses resulting from the provision of Services or any breaches of this agreement.
8. General Provisions
- Governing Law: This agreement is governed by the laws of New Jersey.
- Severability: If any part of these terms is found to be invalid, the rest will continue in effect.
- Amendments: Changes to these terms must be made in writing and agreed upon by both parties.
- Non-Discrimination: Services are provided without discrimination based on race, color, creed, sex, or national origin.
